The short version: My Penguin is a small, private app for two people. What you put in it is yours, your subscription belongs to your nest rather than to either one of you, and if you ever stop paying we keep every memory exactly where it is โ you just can't add new ones until you come back.
Who you're agreeing with
My Penguin is made and operated by Resonant Labs LLC, a Connecticut limited liability company based in Madison, Connecticut. In these terms, "we" and "us" mean Resonant Labs LLC, and "you" means the person using the app.
By using My Penguin, you're agreeing to what's on this page. If you don't agree with it, please don't use the app โ and if something here seems wrong or unfair to you, write to us at support@resonantlab.ai before you go. We'd rather hear it.
How old you have to be
You need to be at least 13 to use My Penguin, and it's designed for adults in a relationship. To buy a subscription you must be 18 or older โ or the age of majority where you live โ because that's a contract. If you're under 18, you can still use a nest someone else pays for.
Your nest
A nest holds exactly two people. One of you creates it, the app gives you a six-digit invite code, and your partner uses that code to join. That's the whole model โ there are no groups, no followers, and no way for a third person to see inside.
Both members of a nest can see everything in it. That's the point of the app, but it's worth saying plainly: anything you add โ a pebble, a photo, an open-when letter โ is visible to the other person in your nest, and there's no private drawer. Please only put things in your nest that you're comfortable sharing with them.
You're responsible for who you invite. If you give your invite code to the wrong person, tell us right away and we'll help.
Your account
Depending on your device, you sign in with Sign in with Apple or with an email address. Keep your sign-in details to yourself โ anyone who can get into your account can read your nest. If you think someone else has gotten in, email support@resonantlab.ai and we'll help you shut it down.
The two of you do not need to sign in the same way. An iPhone and an Android phone share a nest perfectly well; the invite code is what links you, not how you signed in.
Subscriptions and billing
My Penguin is a paid app with monthly and yearly plans. Current prices are shown in the app and on the store listing before you buy, in your local currency.
- A subscription belongs to the nest, not to a person. Whichever of you subscribes, on whichever store, unlocks the app for both of you. You never need two subscriptions, and you should never buy a second one โ if you have, email us and we'll sort it out.
- Your store handles the money, not us. Purchases are processed by Apple through the App Store or by Google through Google Play, under their terms. We never see or store your card details. We're only told whether your nest's subscription is currently active.
- Subscriptions renew automatically until you cancel, and the store charges you at the start of each period.
- Cancel any time, from the store you bought it from โ your Apple account settings or your Google Play subscriptions page. Cancelling stops the next renewal; your subscription stays active through the end of the period you've already paid for. We can't cancel a store subscription for you, though we're glad to walk you through it.
- Refunds are handled by the store under its own refund policy, since the store took the payment. If a refund is issued, the subscription ends and your nest becomes read-only.
- If we ever change the price, we'll tell you before it affects you, and the store will ask you to approve the new price before charging it.
What happens if your subscription ends
Your nest becomes read-only. Every pebble, photo, letter, and open-when note stays exactly where it is, and both of you can still open the app and read all of it โ forever, for free. You just can't add anything new until a subscription is active again. Subscribe again and everything picks back up where it was.
We will not delete your memories because you stopped paying, and we will not hold them hostage to get you to. This is a deliberate promise and it isn't going to change.
Your content is yours
Everything you put into My Penguin belongs to you and your partner. We don't claim ownership of it.
To actually run the app, we need your permission to do the obvious mechanical things with it โ store it, back it up, encrypt it, transmit it between the two of you, and display it back to you inside the app. That permission is limited to operating My Penguin for you, it ends when you delete your content, and it doesn't let us do anything else. We do not sell your content, publish it, show it to anyone outside your nest, or use it to train AI models.
Your penguin's letters are written by an AI, and only if you both agree to it. Either of you can turn that off at any time in Settings, and if either of you says no, none of your content goes to the AI service at all. Exactly what gets sent, and to whom, is spelled out in our privacy policy โ please read that part; it's the most important thing on this page.
The penguin is not an authority on your relationship
The letters are meant to delight you. They're generated by software, they can get things wrong, misremember, or land oddly, and they are not advice โ not relationship advice, not medical or mental-health advice, not anything you should rely on for a decision. If a letter ever lands badly, that's a bug in our judgment, not a verdict on you. Tell us and we'll work on it.
My Penguin is not a crisis service. If you or someone you love is in danger, please contact your local emergency number or a crisis line.
Things not to do
My Penguin is a quiet, two-person space and there's very little that can go wrong in it. Still, please don't:
- Upload content you don't have the right to share, or that's illegal โ in particular, anything sexual involving a minor, which we report and act on without exception.
- Put another person's private information or intimate images into your nest without their consent.
- Use the app to harass, threaten, or abuse the other person in your nest.
- Try to break into other people's nests, reverse-engineer the app, hammer our servers, or get around the subscription.
- Resell the app or your access to it.
If a nest is used for the things in the first three bullets, we may suspend or remove it. We'd rather warn you first, and will where we reasonably can โ but for content that endangers a child, we won't.
Deleting everything
Either partner can permanently delete your shared nest from inside the app, in Settings. It takes confirmation from both of you and then a short grace period, after which every pebble, photo, letter, and account record is permanently removed from our systems. This can't be undone โ so if there's anything you want to keep, save it first.
You can also just ask: email support@resonantlab.ai and we'll delete your data for you and confirm when it's done.
Deleting your nest does not automatically cancel a store subscription. Cancel that separately, in the store you bought it from, or you'll keep being charged for a nest that no longer exists.
Changes to the app
We'll keep improving My Penguin, which means features will change and occasionally something will go away. If we remove something you'd notice โ or change how your data is handled โ we'll tell you in the app before it happens. No quiet edits.
We can't promise the app will never be down. We'll do our best, but software is software.
The legal part
My Penguin is provided "as is," without warranties of any kind, express or implied, to the fullest extent the law allows. We don't warrant that it will be uninterrupted, error-free, or that the penguin's letters will be accurate.
To the fullest extent permitted by law, Resonant Labs LLC is not liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to My Penguin is limited to the amount you paid us for it in the twelve months before the claim. Some places don't allow these limits, in which case they don't apply to you.
These terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws rules, and any dispute will be brought in the state or federal courts located in Connecticut. Nothing here takes away consumer rights you have under the law where you live.
If any part of these terms turns out to be unenforceable, the rest still stands.
Changes to these terms
If we update these terms, we'll change the effective date at the top of this page, and for anything meaningful we'll tell you in the app before it takes effect. If you keep using My Penguin after a change, that's your agreement to the updated terms.
